Structural Guarantee
XIRCON HOMES STRUCTURAL GUARANTEE
Zircon Homes Pty Ltd (ACN 166 351 355) trading as Xircon Homes is pleased to offer you 30 years Structural Guarantee (Guarantee) on your new home. This Guarantee is given in addition to any guarantee, statutory warranty, liability scheme or insurance guarantee in force within the relevant state in Australia and is subject to the terms below.
In this document, Xircon Homes will be referred to as “We”, “Our” or “Us” and the eligible owners named in the building contract will be referred as “You” or “Your”.
TERMS OF THE GUARANTEE Eligibility and Period
1. The Guarantee is only granted specifically to the owner named in the building contract and is not transferable to subsequent owner of the home. Where the owner named in the building contract is a company or a trust, the Guarantee will be limited to 20 years from the issue of the certificate of occupancy or until such time when the controlling interest is transferred. This Guarantee is not transferable or assignable.
2. This Guarantee applies to all new home building contracts signed after 1 April 2021. A copy of the Guarantee is included in your building contract for easy reference.
Eligible Products
The Eligible products include:
(a) Single detached house;
(b) House and land;
(c) Knock down and rebuild.
Inclusions
3. This Guarantee will protect your new home from any structural failure, specifically the foundation and structural components of the timber and steel wall frame and roof framing. This Guarantee covers any of the following:
(a) Foundation systems, concrete or strip footings pursuant to the Building Code of Australia and all relevant Australia Standards;
(b) Structural timbers and steel in wall or roof framing where structural failure is defined under the Building Code of Australia and all relevant Australian Standards;
(c) Load bearing brick work where structural failure is defined under the Building Code of
Australia and all relevant Australian Standards.
4. Please note that this Guarantee is provided to the extent required by legislation current as at the time of the building of your home. It is therefore important that you check the applicable standards as at the time of your building contract, as the standards then will apply. Detailed information about Australian Standards (AS) can be found at www.saiglobal.com.au. (infostore.saiglobal.com/store/ and search for the relevant Standards).
Exclusions
5. The Guarantee does not apply to any structural failure, defects or damage caused by the following circumstances:
(a) Misuse or neglect of your new home;
(b) Fair wear and tear including hairline cracks;
(c) Additions or modifications undertaken to your home post completion under the building contract including alterations, pools, extensions or renovations;
(d) Failure on your part to maintain your new home as outlined in Your Responsibility below;
(e) Failure to follow our site maintenance and care of your new home including but not limited to landscaping, drainage or termite treatment maintenance;
(f) Any site conditions, vandalism, terrorism or any natural and or environmental forces including weather, storms, fires, floods, earthquakes, wind and any termite damage;
(g) Plant growth such as tree roots, growing trees near the foundation of your home, inappropriate planting of garden beds, poorly designed garden landscaping;
(h) Poor surface draining; or
(i) Marks, scratches, dents or defects to any non-structural items.
Your Responsibility
6. Whilst you can be sure that your Xircon Homes home has been built with our commitment to quality building and craftmanship, you are still required to maintain your home in accordance with the documents provided to you as part of your building contract documentation at handover. In addition to any maintenance precautions, the guides below and any revisions from time to time (as applicable in your State) can also provide you with information to care for your new home after completion. Any failure to properly maintain the fittings or fixtures in your home will void this Guarantee.

How to make a claim?
7. A claim made under the Guarantee is to be made in writing and either emailed or posted to Xircon Homes at the contact details below for assessment. Upon receipt of your claim, the following will occur:
(a) We will review your claim and a representative will contact you to attend an inspection.
(b) An assessor will assess and determine whether there is a structural failure that meets the requirements of the Guarantee.
(c) We will respond in writing to advise you of the outcome of the assessment.
(d) Where the structural failure meets the requirements of the Guarantee, we will commence rectification works at our cost within a reasonable time following the assessment.
8. If it is found that the structural failure is covered under this Guarantee, then we will repair the item. Where the item is incapable of repair, we will replace the item to the extent necessary to rectify the structural failure.
9. If it is ascertained that there is no structural failure or that the structural failure does not meet the requirements of this Guarantee, then all rectification costs will be your responsibility.
